Terms of Service
Effective Date: February 16, 2025
Please read this document carefully. It contains important information about your rights and obligations, as well as limitations and exclusions that may apply to you.
This Agreement (“Agreement”) sets forth the terms and conditions governing purchases from BHEG LLC, DBA Beauvoir Hair Extensions (“Beauvoir,” “we,” or “us”) through the website www.beauvoirhair.com (the “Site”) and applies to all orders and transactions between Beauvoir and the purchaser (“Customer”).
By placing an order or using this Site, you agree to be bound by this Agreement. These terms may be updated or modified at any time at Beauvoir’s sole discretion, with or without prior notice.
1. Order Acceptance
Receipt of an order confirmation does not constitute Beauvoir’s acceptance of your order. Orders are accepted only upon Beauvoir’s approval in Hays County, Texas, USA. Beauvoir reserves the right to refuse or cancel any order for reasonable cause, including but not limited to product unavailability, payment issues, or suspected breach of this Agreement. If payment has been made, Beauvoir will promptly issue a refund for any unaccepted or cancelled order.
2. Payment Terms
Payment must be received and authorized before an order is processed. Accepted methods include approved credit cards, wire transfer, or electronic funds transfer. Unless otherwise agreed in writing, payment terms are due immediately upon invoicing. Quotes are valid only for the stated period and may be adjusted at Beauvoir’s discretion.
3. Shipping
Customer is responsible for all shipping-related costs. Accurate contact information must be provided to ensure successful delivery. Beauvoir is not liable for delays, storage fees, or redirection costs caused by Customer unavailability. Shipping discrepancies or damage must be reported within 30 days of delivery to [email protected]
4. Taxes
Customer is responsible for all applicable sales, use, excise, import, and value-added taxes. Such charges will appear as separate line items on invoices where applicable.
5. Title and Risk of Loss
Title transfers to the Customer upon shipment. Beauvoir assumes risk of loss only when using a carrier selected by Beauvoir; otherwise, risk transfers to the Customer upon carrier receipt.
6. Warranties
Products are covered only by the manufacturer’s specific warranty, if applicable. Beauvoir provides no independent warranty beyond those explicitly stated. Warranty claims require a Warranty Authorization (WA) number obtained from Beauvoir’s Claims Department. The returned product must match the authorized item and be received within 30 days of authorization.
7. Disclaimer of Warranties
EXCEPT AS EXPRESSLY PROVIDED, PRODUCTS ARE PROVIDED “AS IS.” BEAUVOIR DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CUSTOMER IS RESPONSIBLE FOR ENSURING COMPLIANCE WITH LOCAL REGULATIONS AND LAWS REGARDING USE OF PRODUCTS.
8. Limitation of Liability
BEAUVOIR’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE PRODUCT(S). IN NO EVENT SHALL BEAUVOIR BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR REVENUE, EVEN IF ADVISED OF SUCH POSSIBILITY.
9. 30-Day Money-Back Guarantee
Products purchased directly from Beauvoir may be returned within 30 days of delivery for a full refund of the purchase price, less shipping and handling. Returned products must be unused, in original condition and packaging, and include all accessories. Custom orders and clearance items are non-refundable.
10. Currency
All prices and payments are in U.S. dollars (USD) unless otherwise stated.
11. Governing Law and Jurisdiction
This Agreement is governed by the laws of the State of Texas, without regard to conflicts of law. The parties consent to the exclusive jurisdiction of the state and federal courts located in Hays County, Texas.
12. Arbitration
Any dispute or claim arising from this Agreement shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA) in Hays County, Texas. Judgment upon the award may be entered in any court of competent jurisdiction. Arbitration does not preclude Beauvoir from seeking injunctive or equitable relief.
13. Entire Agreement
This document constitutes the entire Agreement between Beauvoir and Customer. Any modifications must be in writing and signed by both parties.
14. Pre-Order Terms
Placing a pre-order acts as a deposit only and does not constitute a sale. Delivery dates are estimates and not guaranteed. Customers may cancel pre-orders by emailing [email protected]
15. Mobile Terms of Service
The Beauvoir Hair Extensions mobile messaging service (the “Service”) allows you to receive recurring SMS/text messages about orders, promotions, and updates. Message frequency varies.
